The Provincial Court of Alicante has issued the sentence that condemns the two men accused of killing a third party during a massive fight outside a pub in Xaló on March 27, 2017. The sentence dictates 12 and a half years in prison for a crime of homicide with the aggravating circumstance of abuse of superiority for both.
The sentence, handed down after a popular jury issued a guilty verdict, establishes that the convicted persons must jointly compensate each of the victim's parents with 100.000 euros and 40.000 to the victim's brother.
The events occurred at midnight on March 27, 2017 outside a local pub, when a discussion began between two groups of people motivated by inappropriate comments that one of those groups had made regarding the women who belonged to the other.
The two sides began a fight with shoves and blows during which the victim moved away from his group and was left alone, at which point he began to receive punches in the face and kicks from the two convicts and other members of their group. .
The 24-year-old victim fell to the ground as a result of the group attack and, when he tried to get up, he received a strong kick to the head that left him unconscious. The young man died in the same place a few minutes later.
Although, according to the judicial resolution, it has not been proven that this last blow was given by either of the two convicted persons, both acted jointly and in agreement with one or more other individuals "with knowledge of the probability of causing his death with those blows and taking advantage of the numerical superiority of his group”.
The sentence is not final and can be appealed before the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community.
