The PSPV-PSOE of Pego has reported in a statement that the High Court of Justice of the Valencian Community (TSJCV) has notified the Pego City Council of the resolution on the appeal filed by four members of the Compromís political group. This appeal was directed against the City Council itself, the association of affected people PDAI Pego Golf, and the company in charge of developing the Pego Golf project. The TSJCV has ratified the decision of the Contentious-Administrative Court No. 1 of Alicante, which had already declared the initial appeal inadmissible.
The socialists emphasize that the TSJCV has endorsed the arguments previously set forth by the Administrative Litigation Court. Firstly, it is noted that the four Compromís councillors decided to abstain from the vote in the November 2022 plenary session, where the bases for tendering the Pego Golf project were approved. According to the PSOE, this abstention demonstrates an "incongruent" attitude of the councillors, who did not express their opposition to the project at the corresponding time.
The statement also stresses that the appeal filed by Compromís was rejected because it was filed out of time, which made it "untimely." The TSJCV ruling also requires the appellants to pay the procedural costs.
The City Council, led by the PSOE, requested a technical report to determine whether the Partial Plan related to the project had expired. This report, ratified by technicians from the Regional Ministry of Territorial Policy, Public Works and Mobility, concluded that the Environmental Impact Declaration (DIA) has an indefinite validity as it is an approved partial plan.
The statement also points out that this consultation was carried out to avoid possible legal actions that could financially harm the council, a problem that, according to the PSOE, originated with the approval of the predecessors of the current representatives of Compromís. Finally, the PSOE affirms that the government team has followed the recommendations of experts to avoid lawsuits and protect municipal finances, always prioritizing the general interest of the municipality.
