The CNT-AIT (National Labor Confederation) of the Marina Alta has issued a statement regarding the issue of FIXESA in certain jobs in the Pedreguer City Council. The writing says the following:
Practically since the Pedreguer City Council remunicipalised the municipal building cleaning service that the CNT-AIT has been involved in the struggle of some cleaners to have their rights respected.
This is so because it is no secret that from the first day the cleaners of the town hall were treated as second-class workers, something that all of them would be able to affirm categorically if it were not for the fear that they were nailed to the body, they only became in municipal workers and public employees.
Within the contractual diversity that could be found at that time among the companions, there was a group that were the permanent discontinuous, the contract of which was linked to the cleaning of the two schools in Pedreguer. It was for this reason that at the end of the course the employment relationship was extinguished and it was started again once the new school year began. All of this, sad as it was, was legal.
The city council, at its own risk and without entrusting itself to anyone, decided to substantially modify the conditions of the municipal cleaning service workers and made them sign an extension of the contract that modified the working week they had from Monday to Friday, becoming Monday to Sunday. This modification was also signed by the fixed discontinuities that in theory were only linked in schools and from Monday to Friday. More things happened. The company, in the work quadrants of the cleaning brigade, assigned to the fixed discontinuous enjarjes in the schools, other places and in the morning and afternoon hours and also expanded the number of hours assigned which in principle were a few less and only to be worked in the town schools. Thus until meeting the resolution of the mayor's office of January 29, 2020 where the mayor of Pedreguer orders that ALL cleaners work 35 hours a week like the rest of public employees.
Faced with all these circumstances, which clearly turned discontinuous permanent hiring into a fraud of the law as the reasons for the discontinuity had changed so substantially, the CNT-AIT, through its union section, has requested the Pedreguer City Council to Discontinuous fixed contracts are transformed in fraud of law into fixed contracts to adapt them to the working reality of the cleaners.
We have done it on several occasions and we also did it when presenting the protest table of the CNT-AIT union section to the Pedreguer City Council in relation to the Cleaning Brigade, where in point 3 we demanded "That the contracts of the fixed discontinuities that end all summers become fixed. We consider that they are presumably in fraud of law for many reasons ”. Well, all these reasons are those that we explain above and some more that will be.
All these requests have also been reiterated recently and we have not received a response, or we have obtained the usual response from the City Council on these things. The "many reasons" that we did not expose in our protest table because the company knew them well, now we have publicly exposed that that is why we are the unions and specifically the CNT-AIT.
And we do this in the face of the unanswered response from the city council and in the face of the latest actions taken to avoid its responsibilities. It seems that answering they do not answer, but taking notes they do. Now, the company, in the face of the obvious fraud of the law, has decided to return some cleaners to their original task of cleaning the schools of the municipality by themselves, wanting to pretend nothing had ever happened, and even refuses to let them do the 7 hours ordered by the mayor of Pedreguer. That attitude and those measures do not change reality, and it is that for years the discontinuous fixed cleaners hired to clean the schools from Monday to Friday in the afternoon have been working from Monday to Sunday cleaning all municipal buildings, in the morning and late and above having the bar to finalize the contracts when the school year was over as if they were really doing that task exclusively.
It is for all this that the CNT-AIT of the Marina Alta demands that the discontinuous fixed cleaners see their contract transformed into a fixed one.
